By making a booking with Silent Divers — whether online, by phone, or in person — you confirm that you have read, understood, and agreed to the following terms and conditions in full.
1. Safety, Instructions & Conduct
Scuba diving is an activity that carries inherent risks. Your safety and the safety of others on board depend on strict adherence to our rules.
- You must obey all instructions issued by your Divemaster, Instructor, or Boat Captain at all times — both on the vessel and in the water.
- Failure to follow safety directions may result in your immediate removal from the trip without refund, at the sole discretion of the dive guide or boat captain.
- You accept full personal liability for any injuries, loss, or damage arising from your own negligence, failure to disclose relevant medical conditions, or failure to follow staff instructions.
- Boat decks can be slippery and seas can be rough. You accept responsibility for moving safely around the vessel and following crew direction at all times.
- Alcohol consumption before or during a dive is forbidden. Guests who appear intoxicated will be prohibited from diving without refund.
2. Liability Waiver
By booking with Silent Divers, you acknowledge and accept the following:
Scuba diving involves exposure to a dynamic and potentially hazardous environment. Risks include but are not limited to: decompression illness, equipment malfunction, marine animal encounters, boat-related injuries, and adverse weather.
Silent Divers maintains all equipment to PADI standards and carries emergency oxygen and first-aid equipment on all dive boats. However, Silent Divers, its employees, instructors, and agents shall not be held liable for personal injury, death, loss of property, or financial loss resulting from participation in any of our activities, except where such liability is imposed by Thai law and cannot be contractually excluded.
You confirm that:
- You are medically fit to dive (or have received written physician clearance).
- You have disclosed all relevant medical conditions on the medical questionnaire.
- You understand the nature of the activities and participate voluntarily.
- You have appropriate diving insurance or accept that you dive without it at your own risk.
3. Medical Fitness
All participants must complete a PADI medical questionnaire prior to water activities.
- If you answer “Yes” to any medical question, you must provide written clearance from a licensed physician before we can allow you to dive.
- We are not responsible for any health complications arising from undisclosed or misrepresented medical conditions.
- Conditions that may affect diving eligibility include (but are not limited to): heart conditions, epilepsy, asthma, pregnancy, diabetes requiring medication, and recent surgery. Please consult a diving-qualified physician if you are unsure.
4. Cancellation Policy
We understand that travel plans can change. Our cancellation policy is designed to be fair to both parties:

If we cancel: In the event that Silent Divers cancels a trip due to adverse weather conditions, sea state, insufficient numbers, or mechanical issues, you will be offered a full 100% refund or the option to reschedule at no extra charge. We will provide as much advance notice as possible.
Rescheduling: Subject to availability, we are happy to reschedule your booking up to 48 hours before departure at no cost. Rescheduling requests within 24 hours of departure are treated as a cancellation.
Deposits: Deposits are non-refundable if you cancel within 24 hours of departure. For cancellations outside this window, deposits are refunded as per the table above.
5. Payment Terms
- A deposit (typically 20% of the total booking value) is required at the time of booking to secure your place.
- Full balance must be paid prior to or on the day of participation. No diver will be permitted to board without settled payment.
- We accept: credit/debit cards (Visa, Mastercard), bank transfer, cash (Thai Baht), and QR payment.
- All prices are quoted in Thai Baht (฿). Currency conversion rates are handled by your bank or card provider and are outside our control.
- Pricing is subject to change. The price confirmed at the time of your booking is guaranteed.
6. Equipment & Personal Belongings
- All required scuba equipment is included in your dive trip or course price unless otherwise stated.
- You are responsible for the care of any rented equipment. Damage caused by negligence or misuse may be charged to you.
- Silent Divers is not responsible for the loss or theft of personal belongings on our boats or at our dive centre. We recommend leaving valuables ashore or secured at your accommodation.
7. Course Certification
- PADI course certifications are issued upon full completion of all required theory, confined water, and open water dives to the standard required by PADI.
- Silent Divers reserves the right to decline or defer certification if a student has not met the required competencies. In such cases, additional training may be arranged at an additional cost.
- PADI certification fees are included in course prices unless explicitly stated otherwise.
8. Photography & Marketing
We may photograph or film during our dive trips and courses for promotional purposes. If you do not wish to appear in any marketing materials, please notify a staff member before your activity begins.
9. Governing Law
These Terms & Conditions are governed by the laws of the Kingdom of Thailand. Any disputes will be resolved in the courts of Koh Samui, Surat Thani Province.
